Bupati Garut Terancam Dipanggil Paksa

Kapolda: Bupati Garut Terancam Dipanggil Paksa 
CIANJUR, - Bupati Garut Aceng Fikri, terancam dipanggil paksa Polda Jabar, terkait dugaan penipuan dan pemerasan yang dilaporkan Asep Rahmat Kurnia Jaya. Kapolda Jabar Brigjen TB Anis Angkawijaya, Jumat (7/12/2012) membenarkan hal tersebut.    
Dia mengatakan, Aceng dipanggil untuk kedua kalinya, hari ini (7/12). Dimana pada pemanggilan pertama, Aceng tidak hadir dengan alasan kesibukan sebagai bupati.
Sebelumnya Asep Rahmat Kurnia Jaya melaporkan Aceng Fikri, atas dugaan penipuan dan pemerasan, terkait janji untuk menjadikan dirinya sebagai wakil bupati mengganti Dicky Chandra yang mengundurkan diri.   
"Polda Jabar telah memeriksa delapan orang saksi yang menguatkan dugaan tersebut. Jika hari ini, yang bersangkutan tidak datang, maka kami akan membawa paksa Aceng untuk diperiksa," katanya.
Sementara itu, berdasarkan keterangan Asep Rahmat KJ, setelah Dicky Chandra mengundurkan diri sebagai Wabup Garut, Aceng meminta dia menyediakan uang Rp 1,4 miliar, dengan janji posisi orang kedua di Kabupaten Garut.
Namun ketika itu, Asep hanya mampu memberikan dana sebesar Rp 250 juta. Namun setelah ditunggu-tunggu janji tersebut tidak pernah ditepati, Aceng mengangkat orang lain sebagai wakilnya.
Diberitakan sebelumnya, Bupati Garut Aceng Fikri mangkir dari panggilan Polda Jawa Barat, Jumat (7/12/2012). Alasannya karena tidak enak badan.
"Tekanan darahnya turun sehingga dia harus dirawat beberapa hari," ujar Ujang Suja'i Toujiri, pengacara Fikri.
Ujang mendatangi Polda Jabar bersama dua rekannya. Dia membawa kertas bertuliskan keterangan sakit dari dokter pribadi Aceng Fikri bernama Ade Rusiyana.
Dalam surat keterangan sakit itu, dicantumkan bahwa tekanan darah Fikri mencapai 120/80 mm Hg dengan nadi 80 kali setiap menit.
Ujang mengatakan bahwa Aceng Fikri kelelahan setelah mengikuti Rapat Pansus di DPRD Kabupaten Garut terkait nikah siri yang dia lakukan. Kemudian, Aceng Fikri disarankan dokter dirawat di RS Sentosa Garut.

Why bankruptcy isn't a brand killer


Neither bankruptcy nor a liquidation can kill iconic brands.
Don't say goodbye to the Twinkie yet. Even if its bankrupt parent company shutters, a buyer is likely to revive the brand.
Before the ink was even dry on Hostess Brands' bankruptcy filingWednesday morning, interested buyers were already digging into the potential value of the Hostess name and how Twinkie, Ding Dong or Wonder Bread could be repurposed into other consumer products.
For now, Hostess will continue to churn out Twinkies, but many in the bankruptcy world are questioning whether the maker of snack foods can survive.
This is Hostess Brands' second trip in bankruptcy court. It emerged in 2009 after a four and a half year restructuring.
Should Hostess Brands choose to liquidate rather than reorganize, the brand names - Twinkies, Ding Dongs and Wonder Bread - will very likely live on.
Buyers have made multi-million dollar bets on brand names like Polaroid, Sharper Image and even Borders that continue to resonate with consumers even after the parent company has liquidated.

"The marketplace has, without question, become a lot more sophisticated in terms of intellectual property since the world came to an end in the fourth quarter of 2008," said Jason Frank, a managing director in Hilco's appraisal business which values liquidated brands. "Before that everyone knew brand names were worth something but no one put much value on it."
Several private equity firms, including Hilco, Gordon Brothers and Authentic Brands, regularly show up at intellectual property auctions after a company has decided to liquidate. Rivals to the deceased companies often make bids too, driving up the prices of these brand names.
A big payoff can help the parent company pay back some of its debts.
After Polaroid filed for bankruptcy protection in December 2008, a consortium of buyers paid $88 million in 2009 for the brand name.
Not only did Polaroid's creditors get that lump sum, they also gained a minority stake in the new entity. And that stake could turn out to be quite lucrative if the company sells itself or goes public.
Many potential buyers are also weighing the value of Kodak' (EK,Fortune 500)s brand-name since there's been a lot of talk that it may consider filing for bankruptcy. For now the company plans to restructure out of court.
Kodak's brand name (not its patents) could easily generate more than double Polaroid's sales price, said Jamie Salter, the CEO of Authentic Brands. "There are a lot of categories that Kodak could attach its name to. People would feel very comfortable using Kodak paper," said Salter.
Like Polaroid, Kodak has brand cachet all over the world offering potential buyers the opportunity to tap global markets.

Twinkies will keep coming despite bankruptcy

"Part of what drives so much of this is the Internet economy," said Richard Chesley, a partner in DLA Piper's bankruptcy practice and represented Polaroid's creditors in its bankruptcy. "It's so much easier to get products manufactured globally and consumers in the developing world are often looking for iconic American branded products."
While global consumers might be drawn to shaking lots of things like a "Polaroid picture," in the words of hip hop group Outkast, even brands with significantly less cache like Borders can attract eight-figure investments. Barnes & Noble (BKSFortune 500) spent $13.9 million to buy the rights to its defunct rival's brand name.
A revived Twinkie may make its fans happy but it's unlikely to bring back the 19,000 jobs that would be lost if it decides to liquidate. Nearly 11,000 workers lost jobs at Borders when it liquidated.
The larger question for potential buyers of Hostesses brands is whether Twinkies and Ding Dongs can move into other products?
"For Polaroid and Sharper Image, buyers have been able to use the name and make products within a category of electronics that have a meaning to the consumer," said Cathy Hershcopf, a partner in the bankruptcy practice at the law firm Cooley. "Instead of having a non-name camera or a non-name appliance, suddenly you have a Polaroid camera or a Sharper Image one."
Hershcopf worked on the sale of Sharper Image's name to a consortium of buyers who now license its name to products sold at Target and Best Buy.
If Hostess does sell its brand-name, the question is whether in the low-carb, gluten-free age, will consumers want to see a Wonder Bread superhero?

BlackBerry maker shakes up board


 Research In Motion's joint chairmen and chief executives, Mike Lazaridis and Jim Balsillie, have resigned as part of a long-awaited shake-up at the embattled Canadian maker of the BlackBerry smartphone.
RIM said late on Sunday that Lazaridis would continue to play an active role as vice-chairman and head of a new board committee on innovation. Balsillie is leaving the company, but will remain a director.
The new chief executive will be Thorsten Heins, chief operating officer for product and sales. Heins, a 54-year-old German, joined RIM in 2007 from Siemens, the engineering group.
RIM presented the changes as an orderly succession initiated by the two former chief executives. "There comes a time in the growth of every successful firm that the founders realise that it's time to pass the baton," Lazaridis told the Financial Times.
Barbara Stymiest, former head of the Toronto stock exchange and a senior executive at Royal Bank of Canada, was named chairman. RIM also said that it was seeking a new chief marketing officer. Prem Watsa, a prominent Canadian investor, has joined the board.
However, RIM shares have lost more than three-quarters of their value in less than two years as the company has struggled to respond to mounting competition, especially from Apple's iPhone and Android-based devices.
Shareholders have become increasingly restive over the BlackBerry's sliding market share in North America and by delays in the rollout of new devices and a fresh operating system. Some dissident shareholders have pressed for management to be replaced.

The problems have fuelled speculation that RIM could become a takeover target. Nokia, Microsoft, Amazon and, most recently, Samsung, have been mentioned as possible suitors.
Nonetheless, Heins said, "I'm here to ensure that RIM remains one of the top three wireless leaders in this industry." In particular, he said he planned to "fortify" BlackBerry's position in the corporate market.
"I want to maintain the focus on enterprise, but we need to communicate a bit more with our consumers. We need to do more marketing."
His priorities include the planned launch of a new version of RIM's much-maligned Playbook tablet next month and the rollout later this year of the BlackBerry 10 operating system. He trumpeted these developments as well as the recent launch of the BlackBerry 7.1 device as evidence that RIM is responding vigorously to the challenges it faces.
Lazaridis, an engineer, founded RIM in the late 1980s, while Balsillie, whose expertise is on the marketing side, joined in 1992. Both men are significant shareholders and said on Sunday that they would remain so.
RIM shares dropped 3 percent on Friday to C$17.34. News of the shake-up is likely to prompt an uptick on Monday, although some may be disappointed that the company did not turn to an outsider as the new chief executive.

The Pirate Bay is enemy #1 for digital piracy foes


One day after a massive online protest against proposed new anti-piracy laws, federal agents shut down Megaupload, a popular hub for illegal file sharing.
But the most famous nexus for digital piracy sailed through the week unscathed. It's called The Pirate Bay, and it's the poster child for the kinds of "rogue" overseas sites Congress took aim at with a pair of bills called SOPA and PIPA. (Click here for our explainer: What SOPA is and why it matters.)
Run by an organization registered in the Seychelles, The Pirate Bay bills itself as the "world's largest tracker of BitTorrent files."
BitTorrent is a free software program that lets its 150 million users swap and download large media files. The tool has many legitimate uses, but it's also heavily used to illegally trade movies and other copyrighted content. The Pirate Bay can be confusing to those who aren't fluent geeks. Downloading files requires installing and learning to use torrent software, and the site's ad-choked pages aren't easy to understand at a glance.
But the system is extremely resilient -- and it's a haven for digital piracy. On Friday afternoon, one day after Megaupload's death, more than 36 million computers were connected to The Pirate Bay's network. Recent episodes of the TV shows "Vampire Diaries," "Big Bang Theory" and "The Mentalist" were among the day's most popular downloads, along with the video game "Call of Duty: Modern Warfare 3" and the just-released movie "War Horse."
The Pirate Bay is firmly in the U.S. government's crosshairs. Senator Orrin Hatch, who co-chairs the Congressional International Anti-Piracy Caucus, once denounced it on the Senate floor, and in December, the Office of the U.S. Trade Representative highlighted The Pirate Bay on its list of "markets notorious for privacy."
The Pirate Bay simply operates a tracking network, so none of the copyright-protected files users commonly swap ever sit on the site's own servers. That makes it very hard to kill.
The site has successfully survived a number of assassination attempts in its nine-year existence.
Swedish anti-copyright organization Piratbyrån started The Pirate Bay in late 2003, taking advantage of the country's lax copyright laws. By October 2004, a handful of individuals were running the site independently.
It became a non-profit organization in 2006 -- the same year that brought The Pirate Bay a boatload of legal woes.
On May 31, 2006, police raided The Pirate Bay's office in Stockholm and confiscated the site's servers. The site went down for three days -- some users initially thought it was an April Fool's joke -- and temporarily moved its servers to the Netherlands. Protests broke out on the Swedish streets.
The Pirate Bay blamed the police raid on the Motion Picture Association of America, which acknowledged to Wired that it had "made criminal complaints" to Swedish authorities.
In 2007, Swedish officials charged three Pirate Bay operators and one of its financiers with "promoting other people's infringements of copyright laws." The trial took two years and ended with the conviction of operators Fredrik Neij, Peter Sunde and Gottfrid Svartholm as well as businessman Carl Lundström.
The four were sentenced to one year in jail and a fine of $905,000 each. All except Svartholm, who was ill and skipped his scheduled court appearances, appealed the sentence, and in 2010 it was amended to include less jail time but a higher fine. The case is still ongoing: The three plan to take their battle to Sweden's Supreme Court.
Svartholm hasn't been seen publicly in several years. His whereabouts are unknown.
"Nobody is in contact with him," Sunde told online news site TorrentFreak late last year. "For all we know he might be dead, since no-one can reach him."
'0 torrents will ever be removed': The Pirate Bay's operators aren't fazed by the past legal actions, nor are they ruffled by threats of future lawsuits. They publicly thumb their noses at cease-and-desist letters from copyright holders, some of which are compiled on the site's "legal threats" section.
The Pirate Bay's responses to these letters are also posted: merry, expletive-laden missives that deride companies that cite U.S. laws in their complaints.
As the site told Dreamworks: "As you may or may not be aware, Sweden is not a state in the United States of America. Sweden is a country in northern Europe. Unless you figured it out by now, US law does not apply here. For your information, no Swedish law is being violated."
At the bottom of the Legal Threats page, The Pirate Bay makes its stance even more clear.
"For the law firms who don't get the hint above: we used to have a nice graph here, but it's simpler to just say: 0 torrents has [sic] been removed, and 0 torrents will ever be removed." To top of page
